Privacy and Credit Collection Statement - Kingsmen Group

Kingsmen Capital Partners Pty Ltd ACN 39 690 981 984 and its related companies, including Kingsmen Capital Partners Property Credit Fund 1 Pty ltd ACN 692 092 372, Kingsmen Capital Partners Property Credit Fund 2 Pty ltd ACN 692 093 173 (referred to in this document as Kingsmen, we, us, or our) recognise that your privacy is very important, and we are committed to protecting the personal information and credit-related information that we collect from you.

In this Statement, "personal information" has the same meaning as it does in the Privacy Act 1988 (Cth) (Privacy Act) and "credit-related information" means credit information, credit eligibility information and CP derived information, as those terms are defined in the Privacy Act.

This statement sets out how we collect, use, disclose and otherwise manage credit-related information and personal information. Our separate Privacy Policy sets out how we collect, use, disclose and otherwise manage other types of personal information in a more extensive manner. We will only collect, hold, use, and disclose your personal information in accordance with our Privacy Policy.

Collection

Kinds of information collected

We generally collect, use, hold, and disclose your personal information and credit-related information that you provide for the purposes of assessing your credit-worthiness and for providing credit to you.

The types of personal and credit-related information that we may collect, use, hold, and disclose include:

• your identity particulars, such as name, sex, address and previous two addresses, date of birth, date of birth, name of employer;
• any details listed under any of your government-issued identity documents, including drivers licence or passport details;
• your application for credit, and the amount;
• details of the amount and type of credit that have been provided to you by third parties or which we have guaranteed;
• any credit rating or credit assessment score that we have calculated about you or may be provided to us by a credit reporting body might provide to us;
• details of any credit related court proceedings or insolvency applications that relate to you;
• that we provide you with credit;
• where loan repayments owed by you to us are overdue;
• where overdue loan repayments owed by you to us are no longer overdue;
• financial hardship information;
• credit provided by us to you has been paid or otherwise discharged; and
• any other personal information or credit-related information that we may collect from or about you either now or in the future.

Method of collection

We will collect your personal information and credit-related information if you apply for credit from us. We will collect this information directly from you in most cases, for instance through application forms, telephone calls, or via email. We may also collect it from persons acting on your behalf (for instance financial advisors) or from our related entities. We also collect credit-related information from credit reporting bodies (such as Illion, Equifax, and Experian), or from other credit providers where it is permitted by the Privacy Act.

You acknowledge and consent that, where we collect personal information or credit-related information from third parties, we will only be required to take such steps as are reasonable in the circumstances to ensure that you are made aware of the matters contained in this Statement.

Reasons for collection

We may collect and use your personal information and credit-related information for the purposes of:

• providing credit to you, assessing an application for credit and ensuring the repayment of that credit;
• where you offer to guarantee credit being provided to a third party, assessing whether to accept you as a guarantor in relation to the credit provided by us (or for which an application has been made ) (for example, a company of which you are a director) or any purpose related to the giving of that guarantee;
• risk assessment and management involving securitisation, credit scoring, portfolio analysis, reporting and fraud prevention and claim recovery;
• managing and administering your relationship with us;
• if you give your consent, for marketing purposes (either by the us or by third parties) to promote the products and services provided by us, or other organisations to you;
• verifying your identity and the validity of government-issued identity documents that you have provided; and
• complying with legislative and regulatory requirements.

You acknowledge that we may be unable to process or accept your application for credit or to operate or manage the credit provided to you by us without you providing us with you personal information or credit-related information. You acknowledge that we may need to verify your identity (including where required by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) or other applicable laws). You acknowledge that it is impracticable for you to remain anonymous or use a pseudonym when dealing with us.

Disclosure

Who we disclose to:

We may disclose personal or credit-related information that we collect about you to:

• Our related companies
• Debt collection agencies and credit management agencies
• Credit reporting bodies and other credit providers
• Our service providers
• Our agents, contractors, and external advisors
• Your referees, including your employer
• Your legal and financial advisers
• Real estate agents (where he credit relates to the purpose of property)
• Government bodies and other regulatory authorities (including where this is required or authorized by law)
• Rating agencies
• Payment system operators
• Guarantors and prospective guarantors
• Title insurers
• External dispute resolution bodies; all parties involved in the securitization of our loans
• other financial institutions and credit providers
• other parties named as a "Lender" in the Schedule.

We do not store credit-related information overseas, but we may disclose credit-related information to credit reporting bodies who engage other parties overseas.

Disclosure to credit reporting bodies

Credit reporting bodies (CRB) collect a range of credit related information about individuals. CRB use this information to provide credit reports to their customers relating to individuals who have applied for credit (or are guaranteeing credit). The CRB that we may disclose your credit-related information or, or about your credit-related information from, are:

• Equifax Australia Information Services & Solutions Pty Ltd (whose contact details are available at www.equifax.com.au/contact) (Equifax);
• Experian Australia Credit Services Pty Ltd (whose contact details are available at www.experian.com.au/contact-us/) (Experian).

You acknowledge and consent to these CRB (together with their related bodies-corporate) collecting, holding, using and disclosing your personal and credit-related information for identity verification purposes.

You acknowledge that you may contact each CRB noted above (being illion, Equifax, and Experian) to obtain a copy of their credit reporting policies. You further acknowledge that in certain circumstances you may contact each CRB and request they do not disclose your credit-related information (such as where you believe you are the victim of fraud or identity theft, or for the purposes of pre-screening or direct marketing from credit providers (including us)).

You further acknowledge that where you:

• do not make repayments or instalments of the credit we provide to you;
• commit fraud or try to do so; or
• otherwise commit a serious credit infringement,

we may also disclose this information to the CRB. You acknowledge that this may affect your ability to obtain credit in the future.

Disclosure to Government Departments

Where you provide us with government-issued identity documents (i.e., drivers licence or passport), we and/or any CRB that we deal with may disclose this information in order to verify the document's validity with the Document Verification Service managed by the Commonwealth Attorney General’s Department.

Where you provide us with identity information, we may check this with various government departments via their websites. You acknowledge that your identity information may be checked with government agencies, including but not limited to the Department of Immigration & Citizenship and the Department of Foreign Affairs and Trade. Where we utilise government department websites to check your identity information, you acknowledge that this will be regarded as having assisted us in verifying your personal information and credit-related information.

Access and Correction

Access

You may access the credit information we hold about you by making a written request. We will respond to your request within a reasonable period. In relation to credit eligibility information specifically, we will provide access within 30 days unless unusual circumstances apply.

Except where prohibited by the Privacy Act and the Credit Reporting Privacy Code, we may charge you a reasonable fee for providing access to your personal information (but not for making a request for access).

We may decline a request for access in circumstances prescribed by the Privacy Act. If we do, we will provide you with a written notice that sets out he reasons for the refusal (unless it would be unreasonable to provide those reasons), and notify you that you may access a recognised external dispute resolution scheme of which we are a member, or make a complaint to the Information Commissioner.

Correction

You can ask us to correct your credit-related information. If we are satisfied that your information is inaccurate, our of date, incomplete, irrelevant or misleading, we will take reasonable steps to update your information within 30 days (or such longer period you agree to in writing), and we will provide written notice of that correction.

If we form the view that we will not be able to resolve your correction request within the 30-day time period, we will write to you seeking an extension of time, and notify you that you can complain to a recognized external dispute resolution scheme.
